What is the WSIB?

The WSIB is the Workplace Safety and Insurance Board. The WSIB
promotes workplace health and safety, and provides an insurance
system that compensates workers who are injured on the job.


How We Can Help

The clinic works in the area of workers compensation law. We can
assist clients with a variety of matters, including:

  • Appeals where a worker has been denied loss of earnings
    benefits.
  • Appeals where a worker’s loss of earnings benefits have been
    terminated.
  • Appeals where a worker has been denied labour market re-
    entry services or where the worker disagrees with the labour
    market re-entry plan or early safe and return to work plan.
  • Appeals where a worker has been assessed with a "0" Non-
    Economic Loss award.


Who is eligible for WSIB benefits?

To be eligible for WSIB benefits, you must meet the following
criteria:

  • Have a worker-employer relationship with an employer who is
    covered by the WSIB.
  • Your injury or illness must be directly related to your work.
  • File a claim with the WSIB in a timely fashion.
  • Consent to the release of certain information to your employer
    by the health care.
  • professional treating you.
  • Follow the treatment and health care prescribed by your
    health care professionals.
  • Submit to health examinations as required by the WSIB.
  • Cooperate in your Early and Safe Return to Work program or
    your Labour Market Re-entry program.


What benefits are available?

There are a number of benefits that are available and that you might
be entitled to. They include:
             
  • Benefit for Loss of Earnings (Replacement of earnings you
    lose while disabled by workplace illness or injury.)
  • Benefit for Non-Economic Loss (NEL)
  • Loss of Retirement Income Benefit
  • Benefit for Future Economic Loss
  • Health Care Benefits
  • Health Care Equipment and Supplies
  • The Occupational Disease and Survivor Benefits Program
  • Benefits for Seriously Injured Workers

What should I do if I am injured on the job?

The first thing you should do is get first aid immediately.

Next you should report your injury to your supervisor or employer as
soon as you are able to. You should also write down the names of
any of your co-workers who saw you get injured.
